Terms of Service

1. Acceptance of Terms

By accessing or using the Nanoberry platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Nanoberry provides a batch-processing interface and workflow orchestration layer for generative AI APIs. The Service allows users to utilize dynamic arrays to perform bulk operations using third-party models (including but not limited to Nano Banana Pro).

3. User Accounts

To access certain features of the Service, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Violate the Terms of Service of any third-party API providers connected to the Service (e.g., Nano Banana Pro).
• Attempt to reverse engineer, decompile, or disassemble any aspect of the Service.
• Overload our infrastructure with excessive automated requests outside of the agreed-upon API rate limits.

5. Intellectual Property

• Your Data: You retain all rights to the input data (PDFs, text prompts, array configurations) you upload to the Service.
• Generated Output: Subject to the terms of the underlying AI model providers, you own the rights to the assets generated through your account.
• Service Rights: Nanoberry retains all rights, title, and interest in and to the Service, including our proprietary workflow engine, code, and user interface.

6. Third-Party Services

Our Service integrates with third-party APIs (such as Nano Banana Pro) to function. We do not control these third-party services. We are not responsible for:

• The availability or uptime of third-party APIs.
• The accuracy, quality, or nature of the content generated by third-party models.
• Changes in pricing or access policies by third-party providers.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESSED OR IMPLIED, REGARDING THE ACCURACY OR RELIABILITY OF THE AI-GENERATED CONTENT. YOU ACKNOWLEDGE THAT GENERATIVE AI MODELS MAY PRODUCE INCORRECT OR HALLUCINATED OUTPUTS, AND YOU ARE SOLELY RESPONSIBLE FOR VERIFYING ALL OUTPUTS BEFORE USE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NANOBERRY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice or liability, for any reason, including if you breach these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Philippines, without regard to its conflict of law provisions.
